Scope and Object
These Terms and Conditions regulate the use of this online store and the conditions
applicable to purchases made through it, in accordance with Portuguese legislation
, namely Decree-Law no. 24/2014, of February 14. By placing an order at YCK, you are accepting the Terms and Conditions presented on this page.
Product orders must be placed by Users aged 18 (eighteen) or over (individuals under this age must have authorization from their
representatives). The elements and information transmitted by the User shall enjoy full
legal effect, with the User acknowledging electronic purchases and not being able to claim lack of signature for breach of the obligations assumed.

Products
YCK sells cork products, decorative items and other sustainable products. The product images are for illustrative purposes only. Despite all efforts to ensure the accuracy of the descriptions, there may be slight variations due to the handmade and natural nature of the materials used. If you have any questions, please contact our sales department, who will provide any clarification, either by telephone or e-mail. YCK will do everything possible to ensure that the information presented does not contain typographical errors, which will be corrected promptly whenever they occur. If you purchase a product that has different characteristics to those presented online, you have the right to withdraw from the purchase contract under the applicable legal terms (right of withdrawal – see point 8). YCK will do everything possible to send all the products ordered, but it is possible that, in certain cases and due to causes that are difficult for YCK to control, such as human error or incidents in computer systems, it will not be possible to provide any of the products ordered by the User. In the event of difficulties on the part of YCK in supplying a product, the customer will be informed of the status of their order by e-mail or telephone, and may choose to cancel it or replace it with another product.

Prices
All prices quoted are in euros and include VAT at the legal rate in force. In commercial transactions with non-residents of the European Union, there may be additional taxes, customs and duties not included in the final price, which must be borne by the customer. YCK reserves the right to change prices without prior notice, but undertakes to apply the prices indicated at the time the order is finalized.

Orders
Confirmation of the order represents full and unreserved acceptance of these Terms and Conditions.
Placing an order
To place an order at www.yckportugal.com, the customer must fill in the form provided. You must confirm the data entered on the form before validating your order. YCK is not responsible for any errors made when filling in order forms.
Order confirmation
Confirmation of your order will be sent to the customer by automatic email, provided that the email address provided is correct.
Cancellation of order
The customer can cancel their order at any time as long as it has not been dispatched. This cancellation must be communicated by e-mail to geral@yckportugal.com.

Payment
The payment methods available are:

  • Credit Card
  • MBWay
  • Multibanco Reference
  • PayPal

Orders will only be processed once payment has been confirmed.

Lack of payment
YCK reserves the right not to deliver an order in the event of total or partial non-payment of an ordered product. Once an order has been placed, all payments must be made within a maximum of 15 days. Once this period has elapsed, the order will be canceled.
Invoice
The order form sent to www.yckportugal.com does not serve as an invoice. The customer will only receive their invoice together with the products ordered.

Deliveries
Deliveries are made to mainland Portugal and the islands, other countries in the European Union and also to countries outside the European Union. Shipping costs depend on the destination and the total weight of the order and will always be calculated before the order is finalized.

Most of our products will be shipped within a maximum of 6 working days, for products available from stock. For countries outside the European Union, customs may charge additional fees. These fees
are not our responsibility and vary according to the country. We do not take responsibility for delays due to customs. We will never be responsible for undelivered orders, unless insurance has been included, and refunds will not include shipping costs.

Right of Free Resolution
The customer has the right to withdraw from the contract within 14 calendar days from
date of receipt of the order, without having to state a reason, in accordance with the provisions of
Decree-Law no. 24/2014. To exercise the right of return, the customer must communicate their decision by email to geral@yckportugal.com, indicating the order number. Items returned without prior request for return will not be accepted. The product must be returned in perfect condition, without signs of use, and in its original packaging. If any of the components of the item sold are missing, or if any of them are not in excellent condition, there will be no refund. Refunds will be made within 14 days of receipt of the returned product. The amount of the refund will be limited to the cost of the product, shipping costs will not be refunded, except in cases of product defect or exchange. Personalized or custom-made products cannot be returned.

Complaints
The User may submit any contractual disputes to the arbitration mechanisms and mediation that are or will be legally constituted (alternative dispute resolution – see point 10) and www.livroreclamacoes.pt, as well as complain to YCK via e-mail geral@yckportugal.com about acts and omissions that violate the legal provisions applicable to the purchase of goods. The complaint must be submitted within a maximum of 30 (thirty) days of the User becoming aware of the facts, and will be recorded in YCK’s information systems, which must decide on the complaint and notify the interested party within a maximum of 30 (thirty) days from the date of receipt.

Alternative Dispute Resolution
In the event of a consumer dispute, the customer may resort to an alternative dispute resolution body. More information is available at: https://www.consumidor.gov.pt Centro de Arbitragem de Conflitos de Consumo de Lisboa (CACCL)

Data Protection
The personal data provided by customers is treated confidentially and used only for the purposes of processing the order and communicating with the customer. YCK complies with the General Data Protection Regulation (GDPR). For more information see the Privacy Policy.

Responsibilities
The Store has adequate security levels, however YCK shall not be liable for any damages suffered by the User and/or third parties as a result of delays, interruptions, errors and suspensions of communications caused by factors beyond its control, in particular any deficiencies or failures caused by the communications network or communications services provided by third parties, the computer system, modems, connection software or any computer viruses or arising from the downloading (“download”) through the service of files infected or containing viruses or other properties that may affect the User’s equipment. If for any reason access to the YCK Online Store website is not possible, YCK shall not be liable for any damages. Data and information queries made within the scope of this Service are presumed to have been made by the User, and YCK shall not be held liable for any misuse or fraudulent use of the information obtained. YCK shall not be liable for any loss or damage caused by misuse of the Service which is not directly attributable to it by way of intent or gross negligence.

YCK shall not be liable for any loss or damage arising from non-compliance or defective compliance with the Service when this is not directly or indirectly attributable to it by way of willful misconduct or gross negligence, and shall not be liable in particular for (i) errors, omissions or other inaccuracies relating to the information made available through the Service; (ii) damages caused by the fault of the User or third parties, including violations of intellectual property, (iii) non-compliance or defective compliance resulting from compliance with judicial decisions or administrative authorities or (iv) non-compliance or defective compliance resulting from the occurrence of situations of force majeure, i.e., situations of an extraordinary or unforeseeable nature, external to YCK and which cannot be controlled by it, such as fires, power cuts, explosions, wars, riots, civil insurrections, government decisions, strikes, earthquakes, floods or other natural cataclysms or other situations not controllable by YCK that prevent or impair the fulfillment of the obligations assumed.

YCK does not warrant that

  • the Service is provided on an uninterrupted basis, is secure, error-free or works infinitely;
  • the quality of any product, service, information or any other material purchased or obtained through the Service fulfills any of the User’s expectations in relation thereto;
  • any material obtained in any way through the use of the Service is used at the User’s own risk and the User is solely responsible for any damage caused to their computer system and equipment or for any loss of data resulting from such operation.
  • No advice or information, whether oral or written, obtained by the User from or through the Service shall create any warranty that is not expressed in these General Terms and Conditions.

The User accepts that YCK can in no way be held liable for any damages, including, but not limited to, damages for loss of profits, data, content, or any other losses (even if it has been previously advised by the User of the possibility of the occurrence of such damages), resulting from:

  • the use or inability to use the Service;
  • the difficulty of obtaining any substitute goods/services;
  • unauthorized access to or modification of personal databases.

Changes to the Terms and Conditions
YCK reserves the right to change these Terms and Conditions at any time, and the changes will be published on the website with an updated date. It is therefore advisable to consult the terms of use regularly, since frequent use of the site implies acceptance of the changes made and the customer is subject to the latest version. The general terms and conditions in force on the date of the order will be those applied to commercial transactions between YCK and its customers.
